TERMS AND CONDITIONS
1. Object
The contractual relations between Vahina and the customer, whether professional or individual, as well as the conditions applicable to any acquisition made on the site, are defined by these conditions of sale.
The purchase made by the customer entails his full acceptance of these conditions of sale, without any reservation.
The conditions of sale set out by Vahina prevail over all other general or specific conditions which have not been expressly approved.
Vahina reserves the right to modify the conditions of sale at any time. The conditions in force at the time of purchase by the customer apply.
2: Place an order
The customer places his order using the order form. The customer has the option of contacting Vahina by email or telephone in order to obtain information. The accepted payment method is Credit Card on the secure Stripe platform.
Orders are processed in the order of their receipt and according to the availability of the products offered for sale. In the event of a stock shortage, the customer is informed and has the option to cancel their purchase. In this case, all payments made are fully refunded.
3: Prices
The prices displayed on the sales pages are expressed in euros, all taxes included.
All orders, whatever their origin, must be paid in euros.
Vanille de Madagascar reserves the right to modify prices at any time. The price indicated on the sales page at the time of the order is the only one applicable to the customer.
4: Availability
The products are offered while stocks last. In the event of unavailability of a product, Vahina undertakes to promptly inform the customer by telephone or email. In this situation, Vahina undertakes to offer an equivalent product available or to fully reimburse the customer for the product ordered.
5: Payment methods
Payment is due upon ordering.
For payments by check, the order is only shipped after receipt of the corresponding check, the same for payments by bank transfer.
Failure to pay results in the suspension or cancellation of the order.
6: Delivery terms
Items are shipped to the address provided by the customer when ordering. Upon receipt of the package, it is the customer's responsibility to check its condition and, if necessary, to notify the carrier of any defect or damage by recording written remarks and signing them. The customer must also inform Vahina within the day.
In the event of a delivery error, any product must be returned in its original packaging after obtaining Vahina's prior agreement. The product will then be reshipped or exchanged, with reimbursement of shipping costs, unless the returned product does not correspond to the customer's initial declaration. Delivery costs are free for all orders exceeding a certain amount and depending on the country of delivery.
Items are delivered to your home by post, courier service or relay point. The customer can also request to collect their order directly from Vahina headquarters.
The delivery times indicated are given for information purposes only and correspond to usual delivery times. Vahina undertakes to deliver within 2 to 5 working days, excluding weekends and public holidays, except in cases of force majeure.
Vahina declines all responsibility in the event of problems related to delivery attributable to carriers. Overseas shipping times are 5-10 days.
Complaints regarding delivery issues must be made within 48 hours of receipt of packages. Damaged or broken items will be refunded. Disputes relating to deliveries made by carriers will not be refunded if the carrier can provide proof of delivery.
Vahina reserves the right to offer credits as compensation to its customers. In the event of non-recovery of a package delivered to a relay point within the allotted time frame, delivery costs remain the responsibility of the customer. The latter can request a new shipment of the package by repaying the delivery costs or request a refund of the products.
7: Place an order
The customer certifies having verified that the product corresponds to his needs and having received from Vanille de Madagascar all the information necessary to proceed with his commitment in full knowledge of the facts. The customer declares to be of legal age or to have parental authorization allowing them to place an order on the site. The customer affirms that the bank account associated with his payment card during payment belongs to him or that he has obtained legitimate authorization from the account holder to use it.
8: Right of withdrawal
According to the provisions of articles L-121-16 and following of the Consumer Code, the customer has a period of fourteen days to exercise his right of withdrawal, without having to provide reasons or pay penalties, upon 'except for return costs. If the fourteen-day period expires on a public holiday, Saturday or Sunday, it is extended until the first working day that follows. The returned product must be in perfect condition and put back in its original packaging. It must be returned by registered mail with acknowledgment of receipt, accompanied by the invoice. Any product damaged or whose packaging is damaged will not be exchanged or refunded.
Beyond 14 days, Vahina reserves the right to decide whether or not to accept return requests. When a return is accepted, it is refunded in the form of a credit.
9: Responsibility
The product complies with current French legislation and the standards applicable in France. Vahina cannot be held liable in the event of non-compliance with the legislation of the country of delivery of the product. It is the customer's responsibility to check with the local authorities in his country of residence the conditions of use of the product he plans to order on the site.
Vahina cannot be held responsible for non-delivery of the product if the address provided by the customer is obsolete or invalid, or if the customer's mailbox is inaccessible or out of service.
10: Applicable law – dispute
The sale between Vahina and its client is governed by French law. In the event of a dispute, only the Paris Commercial Court has jurisdiction, even in the presence of several defendants or warranty claims.
